TCPA Compliance Updates & Best Practices for PushPress Grow

Grow clients can remain TCPA-compliant, reduce legal risks, and continue using SMS effectively while protecting their business.

With the latest TCPA consent rules in place, here’s what PushPress Grow users need to know to stay compliant while continuing to engage their leads and members effectively.


Updates to Grow’s Opt-In Forms

  • Already Updated & Compliant – PushPress has made all necessary changes to Grow’s opt-in forms.

    • Existing clients remain compliant with the new TCPA consent rules.

    • Remain compliant with all new leads entering your Grow account through your website.

Re-Confirming Consent for Old Lead Lists

If a Grow client wants to add an old list of contacts into their Grow account, they should follow one of these options:

Preferred Method (Preferred):

  • Send an email with to contacts on the list with a form attached where recipients can opt-in explicitly.

Alternative (Not Preferred):

  • Send a one-time opt-in SMS message like this:

    • “Hi {{Name}}, {{GymName}} would like to connect with you through SMS. Do you give consent to receive messages from {{GymName}}? Reply “Yes” to opt-in, or reply “No thanks” to opt-out forever. You can opt back in anytime by replying “Start.”

Failure to Honor “Stop” Requests

If a Grow client does not honor a “Stop” request within 10 business days, a fine will be issued to the Grow client directly.

  • The penalty letter, including payment details, will be sent to the client’s local address.

  • Fines are assessed by telecommunications carriers; not PushPress.

  • PushPress will not bear responsibility for TCPA violations.

Ensuring Core SMS Compliance

  • Grow’s SMS functionality is already TCPA-compliant. No additional changes are needed at this time for Core.

Automated Opt-Out Handling in Grow

  • No manual workflows required! – Grow will automatically opt out and apply a Do Not Disturb (DND) tag to contacts who reply “Stop.”

Educating Grow Clients Without Overwhelming Them

Key Strategies:

  • Onboarding? – Consult your PushPress on-barding representative for compliance training during new client onboarding.

  • CRM Setup Rules Agreement – Clients must review and agree to compliance rules when setting up their CRM.

Handling Violations & Legal Responsibility

  • If a Grow client violates TCPA rules, they are fully responsible for any penalties incurred. PushPress does not assume liability for client non-compliance.

Grow’s Bulk Messaging Warnings

  • New Warning Added! – Grow now alerts users that sending non-compliant bulk messages may result in a $1,500 fine per violation.

Proactively Verifying Consent Status

  • Best Practice: Grow clients should regularly clean their contact lists to ensure all members have valid, documented consent for SMS communications.
